AUTO CABEZA DE PROCESO. Cuando el funcionario de instrucción, reciba denuncia o cuando se encuentre en el caso previsto en el artículo anterior, dictará un auto cabeza de proceso en que, fundándose en el conocimiento que ha tenido del hecho, resolverá abrir la investigación correspondiente al descubrimiento de los hechos, de sus autores o partícipes, de la personalidad de éstos, de los motivos determinantes y de la naturaleza o cuantía de los perjuicios.
