De conformidad con el artículo 1° del Decreto 2591 de 1991, la acción de tutela protege exclusivamente los derechos constitucionales fundamentales, y por lo tanto, no puede ser utilizada para hacer respetar derechos que tienen rango legal, ni para hacer cumplir las leyes, los decretos, los reglamentos o cualquiera otra norma de rango inferior.
