º En los procesos que se adelanten conforme a este Decreto, no habrá lugar a excarcelación cualquiera que sea el delito. Cuando la sentencia se primera instancia fuere absolutoria, los detenidos quedarán en libertad bajo fianza mientras el Tribunal no haya confirmado la sentencia.
