Art. 1938. El pacto comisorio prescribe al plazo prefijado por las partes si no pasare de cuatro años, contados desde la fecha del contrato.

Transcurridos estos cuatro años, prescribe necesariamente, sea que se haya estipulado un plazo mas largo o ninguno.
