Cuando no se logre la captura del autor del delito, de sus cómplices o auxiliadores, se les emplazará por edicto que debe permanecer fijado en la Secretaría por el término de cinco (5) días. Si transcurrido éste plazo no comparecieren, se les declarará reos ausentes, se les nombrará defensor de oficio y con éste se seguirá el juicio hasta su terminación.
