Adiciónase el artículo 420 del Estatuto Tributario, con el siguiente parágrafo.

"Parágrafo 5º . La venta e importación de cigarrillos y tabaco elaborado, nacionales y extranjeros, los cuales estarán gravados a la tarifa general. El impuesto generado por estos conceptos dará derecho a impuestos descontables en los términos del artículo 485 de este estatuto.

La base gravable del impuesto a las ventas sobre los cigarrillos y tabaco elaborado será la misma del impuesto al consumo de que trata el artículo 210 de la Ley 223 de 1995 ".
