Período de permanencia y penalizaciones. El período mínimo de permanencia de cada aporte que se realice en un fondo de inversión inmobiliaria abierto con pacto de permanencia, será de cinco (5) años. El administrador establecerá penalizaciones por retiros que se realicen antes de cumplirse este plazo, las cuales se estipularán como porcentajes del monto retirado que dependerán únicamente de la duración de la inversión. Estas penalizaciones deberán ser estipuladas en el contrato de vinculación al fondo.

Parágrafo

Las penalizaciones se contabilizarán como un ingreso del fondo.
