El disponente está en el deber de manifestar la existencia de gravámenes, derechos de usufructo, uso y habitación, servidumbres, limitaciones o condiciones y embargos o litigios pendientes, y en general, toda situación que pueda afectar al inmueble objeto de su declaración o los derechos constituidos sobre él, y si lo posee materialmente.
