ARTICULO 50 . DECLARATORIA DE INSUBSISTENCIA DEL NOMBRAMIENTO POR CALIFICACIÓN DE SERVICIOS. El nombramiento del empleado escalafonado en la carrera deberá declararse insubsistente por la autoridad nominadora cuando haya obtenido una calificación de servicios no satisfactoria, para lo cual deberá oírse el concepto no vinculante de la Comisión de Personal. Contra el acto administrativo que declare la insubsistencia, procederán los recursos de ley con los cuales quedará agotada la vía gubernativa.
