Cuando el concesionario permita el uso de la licencia de funcionamiento por terceras personas, el concesionista declarará la caducidad del contrato o revocatoria de la licencia de funcionamiento, sin perjuicio de la facultad de hacer efectiva la cláusula penal y/o la fianza.
