Sin esperar denuncio ni querella alguna, ni orden superior, debe el funcionario de instrucción correspondiente instruir sumario siempre que, por conocimiento personal, por avisos confidenciales, por notoriedad pública o por cualquier otro medio, llegare a su noticia la perpetración de alguna Infracción penal de la que deban investigarse de oficio.
