Sin perjuicio de la investigación penal a que hubiera lugar el funcionario que haya hecho la designación podrá en cualquier tiempo, de oficio o a solicitud del Ministerio Público, de la Superintendencia de Notariado y Registro o de cualquier persona, separar del cargo plano, hasta que se pronuncie la decisión disciplinaria, a quien haya entrado a ejercerlo con funcionamiento en la certificación o declaración manifiestamente apócrifas. La providencia que en tal sentido se dicte se comunicará a la primera autoridad política del lugar, para que disponga el encargo a que hubiere lugar. IV. SITUACIONES ADMINISTRATIVAS
