El artículo 39 del Decreto 1910 de 1942, quedará así: "En caso de que un ingeniero retirado del servicio que tenga derecho a la devolución de las cuotas que hubiere consignado, llegare a fallecer sin haberlas reclamado, dichas cuotas, previa deducción de un diez por ciento (10%), se devolverán siguiendo para su distribución, las reglas establecidas en el artículo 35."
