Los ascenso a General de Brigada y a General de División se harán por selección, después de un año de servicio en el grado inmediatamente anterior; de haber mandado con buen éxito durante este tiempo la correspondiente Unidad, o haber concurrido a maniobras formales, donde haya tenido ocasión de mandar satisfactoriamente por lo menos un destacamento o hecho una campaña en la que su conducta no se haya hecho censurable, a juicio de un Consejo de Guerra, y además, que haya la vacante.
