Siniestro por culpa grave o dolo . Si de la investigación apareciere que hay graves indicios de que el siniestro fue ocasionado por dolo o culpa grave del Capitán de la nave, de los Oficiales, de la tripulación o del práctico, se procederá así: 1) Para autorizar el zarpe, previamente deberá cambiarse al Capitán, Oficiales o tripulación inculpados. 2) Si el Capitán, Oficiales o tripulantes fueren colombianos se les suspenderá la licencia de navegación, hasta que se produzca el fallo de segunda instancia. A igual medida se someterá el práctico.
