El acta hace fe, mientras no sea tachada de falsedad y probada la tacha, de todo lo que el Juez o funcionario atestigüe haber hecho u observado o que ha sucedido en su presencia; pero no impide, por parte del Juez, la libre apreciación, de los hechos atestiguados o de las declaraciones recibidas en la diligencia.
