Art 5°. En caso de divorcio declarado por causa de adulterio, el marido podrá en cualquier tiempo reclamar contra la legitimidad del hijo concebido por su mujer durante el matrimonio, siempre que durante la época en que pudo tener lugar la concepción, no hacía vida conyugal con su mujer. Este derecho no puede ejercitarse sino por el marido mismo.

Queda así adicionado el artículo 217 del Código Civil.
