En la tramitación de los recursos se observara el trámite previsto en el Decreto 2733 de 1959. De acuerdo con lo ordenado por el Decreto 528 de 1964 y demás disposiciones pertinentes, de las controversias relativas a contratos administrativos celebrados por el Instituto, en los cuales se hubiere pactado la cláusula de caducidad, conocerá la justicia administrativa; y la justicia ordinaria de las originadas en los demás contratos.
