Son causales de falta absoluta el fallecimiento, la renuncia, la incapacidad para el ejercicio del cargo, el traslado de la residencia fuera de la jurisdicción territorial y la condena penal por hechos punibles.

Si se produjere falta absoluta por parte del juez de paz antes de asumir el cargo o durante su período, se procederá a una nueva elección, por el término que le faltare de acuerdo con el trámite previsto en el artículo 11 de la presente ley.
