El Consejo de Guerra tendrá el siguiente personal: Un Presidente, que será el mismo Juez de primera instancia; tres Vocales que serán Oficiales pertenecientes a la misma repartición, sorteados de listas elaboradas anteriormente; caso de que no existiera personal suficiente para ello, podrá incluirse en las listas nombres de Oficiales de otra repartición o en retiro; un Fiscal y un Secretario, nombrados por el juez.
