Producida la situación a que el artículo 5.° se refiere, el Departamento de Santander podrá optar entre terminar la obra del ferrocarril o sustituirla en todo o en parte por una carretera ejecutada sobre la línea trazada para la construcción de dicho ferrocarril, cuya construcción, mantenimiento y explotación gozará de los mismos recursos y derechos que por esta Ley se le conceden para la obra del ferrocarril.
