La pena es de quince a treinta años de presidio, si el homicidio se comete con premeditación acompañada de motives innobles; o con cualquier circunstancia que ponga a la víctima en condiciones de indefensión o inferioridad, como la insidia, la asechanza, la alevosía, el envenenamiento; o con sevicia.
