° Los Departamentos, previo concepto favorable del Ministerio de Obras Públicas, organizarán y cobrarán peaje en las carreteras departamentales que están pavimentadas o que se pavimenten, así como en las nacionales que pavimenten los Departamentos, cuando la intensidad del tráfico y otros factores justifiquen tal cobro, y con el exclusivo objeto de destinar el producto del tributo a la conservación de las mismas vías.
