La gracia concedida por la presente Ley no cobijará a los reincidentes, ni a aquellos que hubieren delinquido durante su detención, ni a los prófugos, ni a los reos ausentes, y se otorgará sin perjuicio a los beneficios de la libertad condicional prevista en el artículo 85 del Código Penal, y de la libertad preparatoria de que tratan los artículos 330 y 331 del Decreto 1817 de 1964.
