° El reconocimiento de la personería jurídica es requisito indispensable para que una entidad de carácter docente sea considerada como establecimiento de educación superior.

Parágrafo 1

Los establecimientos de educación superior que dependan o sean apovados por una fundación, asociación o sociedad deben constituirse como personas jurídicas autónomas.

Parágrafo 2

El presente artículo rige para los establecimientos de educación superior que se constituyan a partir d ella vigencia del presente Decreto.
