Vigencia . La habilitación será indefinida mientras subsistan las condiciones exigidas y acreditadas para su otorgamiento en cuanto al cumplimiento de los requisitos establecidos por las disposiciones pertinentes. El Ministerio como autoridad competente podrá en cualquier tiempo de oficio o a petición de parte, verificar las condiciones que dieron origen a la habilitación. En todos aquellos casos de transformación, fusión, absorción o incorporación, la empresa comunicará este hecho al Ministerio de Transporte y a la Superintendencia de Puertos y Transporte o la entidad que hiciere sus veces, adjuntando los nuevos certificados de existencia legal, con el objeto de estudiar la autorización para que la nueva empresa pueda operar el servicio.
