º. Confidencialidad. Los proveedores de redes y servicios de telecomunicaciones, los funcionarios de la Fiscalía General de la Nación y aquellos que ejerzan funciones de Policía Judicial que tengan acceso a cualquier tipo de información o datos con ocasión o en ejercicio de sus funciones o participen en actividades relacionadas con la interceptación de comunicaciones, se obligan a garantizar la reserva de los datos y la confidencialidad de la información, so pena de las investigaciones penales y disciplinarias a que haya lugar.
