ARTICULO 249 . Imparcialidad del funcionario en la búsqueda de la prueba . El funcionario judicial buscará la determinación de la verdad real. Para ello debe averiguar, con igual celo, las circunstancias que demuestren la existencia del hecho punible, agraven o atenuen la responsabilidad del imputado, y las que tiendan a demostrar su inexistencia o lo eximan de ella. Durante el juzgamiento, la carga de la prueba del hecho punible y de la responsabilidad del procesado corresponde a la fiscalía. El juez podrá decretar pruebas de oficio.
