El dueño, el poseedor o tenedor legitimo de las cosas aprehendidas durante la investigación y que no deban confiscarse, podrá demandar su restitución ante el juez o funcionario de instrucción comprobada la propiedad, posesión o tenencia legítima por el demandante, el juez o funcionario, salvo lo prescrito en el artículo 318, decretará la entrega, previo avalúo de las cosas cuya restitución se ordena.
