º . Rechazo de la solicitud de devolución . La solicitud se rechazará en los siguientes eventos

a)

Cuando se presente extemporáneamente;

b)

Cuando la retención objeto de solicitud haya sido incluida en una solicitud anterior, o haya sido objeto de devolución o compensación anterior;

c)

Cuando se demuestre que se trata de retenciones no practicadas o por inexistencia del retenedor.
