Para efectos de la excepción prevista en los artículos 1° y 13 de la Ley 20 de 1969 , se entiende por derechos constituidos a favor de terceros las situaciones jurídicas subjetivas y concretas, adquiridas y perfeccionadas por un título especifico de adjudicación de hidrocarburos como mina o por una sentencia definitiva y en ejercicio de los cuales se hayan descubierto uno o varios yacimientos de hidrocarburos, a más tardar el 22 de diciembre de 1969.
