La extradición se concederá u ofrecerá de acuerdo con los tratados públicos.

A falta de tratados públicos, el Gobierno ofrecerá o concederá la extradición conforme a los trámites establecidos en el Código de Procedimiento Penal, y previo dictamen favorable de la Corte Suprema de Justicia en el segundo caso.

No se concederá la extradición de colombianos ni la de delincuentes político-sociales.
