º Si en el plano o croquis presentado por el interesado apareciere de manifiesto que la mina que se trata de matricular se superpone en todo o en parte sobre otra matriculada, se dará aviso de este hecho al interesado para que dentro de los treinta (30) días siguientes manifieste lo que estime conveniente al respecto. Sí insiste en su voluntad, se procederá en la forma señalada en los artículos 40 y siguientes de este Decreto, sin perjuicio de que el interesado vencido pueda hacer valer las acciones legales que sean pertinentes.
