"ARTICULO 3º

"Si se trata de una disputa cuyo objeto, de acuerdo con la legislación interna de una de las Partes, cae bajo la competencia de los tribunales nacionales de ésta, inclusos los tribunales administrativos, dicha Parte podrá oponerse a que la diferencia sea sometida al procedimiento previsto por el presente Tratado antes de que una sentencia dictada en calidad de cosa juzgada no haya sido expendida, dentro de los plazos establecidos por las legislaciones internas respectivas, por la autoridad judicial nacional competente.
