Artículo segundo. Si de dicho informe el Inspector dedujere que los trabajadores colombianos mayores de cuarenta años (40), no alcanzan proporción del diez por ciento (10%) del total de trabajadores ordinarios y del veinte por ciento (20%) sobre los demás trabajadores calificados o de dirección o confianza, podrá imponer multas sucesivas de quinientos pesos ($500.00) a dos mil pesos ($2.000.00), hasta cuando el patrono respectivo acredite el cumplimiento del mandato contenido en el artículo 1º de la Ley 15 de 1958.

Parágrafo

No se aplicará la sanción prevista en este artículo si el patrono demostrare que no le han sido formuladas solicitudes de trabajo por parte de colombianos mayores de cuarenta (40) años, o cuando habiéndolas recibido, no hubiere contratado personal nuevo.
