El beneficio de separación a favor de un acreedor debe decretarse de plano si se presenta un TITULO que preste mérito ejecutivo. La providencia en que se decreta sólo es apelable en el efecto devolutivo,y ha de registrarse si entre los bienes de la sucesión hay inmuebles.
