CONOCIMIENTO A PREVENCION

1.

Cuando el Ministerio de Trabajo y de Seguridad Social o el Ministerio de Salud, a través de sus dependencias, hubiere iniciado una investigación por violación de las normas que Reglamentan la Salud Ocupacional, el ISS se abstendrá de abrir investigación por la misma conducta, pero tendrá derecho a que la respectiva entidad oficial le informe sobre su resultado, para los efectos legales y reglamentarios a que hubiere lugar.

Cuando el Instituto tuviere conocimiento que la conducta violatoria ha sido sancionada por los funcionarios competentes del Ministerio de Salud o del Trabajo y Seguridad Social, se abstendrá de imponer una nueva sanción por la misma infracción.

3.

Cuando el Instituto sancione una empresa por violación a las normas de salud ocupacional, así lo informará al respectivo Comité de Medicina, Higiene y Seguridad Industrial de la Empresa y la respectiva dependencia administrativa del Ministerio de Salud o del Ministerio de Trabajo y Seguridad Social, para lo de su cargo.
