No se realizará concurso de ingreso al servicio cuando se inscriban menos de 5 personas para el cargo que se va a proveer. Se declarará desierto cuando por lo menos tres aspirantes a una misma notaria no haya obtenido el puntaje mínimo de 60. No realizado o declarado desierto el concurso, se proveerá el cargo en interinidad. En este caso se designará a quien desempeñe o haya desempeñado el cargo en propiedad y hubiere obtenido calificación suficiente en el concurso, si éste se hubiere realizado.
