Cometen infracción militar los militares en actividad y las civiles al servicio de las Fuerzas Militares, que violen las disposiciones del presente Código, en los términos establecidos por el mismo.

Parágrafo

Cuando medie concierto, la orden superior no exime de responsabilidad al inferior.
