Los trabajadores que entren a prestar servicio militar, por llamamiento ordinario o en virtud de convocatoria de reservas, tienen derecho a que se les liquide y pague parcial y definitivamente el auxilio de cesantía, cualquiera que sea el tiempo de trabajo y sin que se extinga su contrato conforme a lo dispuesto en el ordinal 5o. del artículo 51.
