Devolución de bienes aprehendidos. El dueño, poseedor o tenedor legítimo de los bienes aprehendidos durante el proceso y que no deban pasar a poder del Estado, podrán demandar su devolución ante el funcionario de investigación o el Juez. Comprobada la propiedad, posesión o tenencia legítima por el demandante, el funcionario de investigación o el Juez, salvo lo prescrito en el artículo siguiente, decretará la entrega, previo avalúo de los bienes cuya devolución se ordena.
