ARTICULO 43. DECLARATORIA DE INSUBSISTENCIA DEL NOMBRAMIENTO POR CALIFICACIÓN NO SATISFACTORIA. El nombramiento del empleado de carrera deberá declararse insubsistente por la autoridad nominadora cuando haya obtenido calificación no satisfactoria como resultado de la Evaluación del Desempeño Laboral anual o extraordinaria, para lo cual deberá oírse previamente el concepto no vinculante de la Comisión de Personal.
