En caso de muerte de un empleado u obrero de los enumerados en el artículo 1° de esta Ley a cuyo favor se haya decretado una jubilación, ésta pasará por el término de cinco años a su legítima esposa si viviere y a falta de ella a los hijos legítimos del extinto, menores de edad.
