Las armas, instrumentos y efectos con que se haya cometido un delito, o que provengan de su ejecución, se confiscarán y entregarán al Estado, a menos que la ley disponga que se destruyan, o que se devuelvan a quien se hubieren sustraído o a un tercero sin cuya culpa se hubiere usado de ellos.
