Las personas naturales o jurídicas perjudicadas con el delito, o sus herederos, podrán ejercer la acción civil dentro del proceso penal, constituyéndose parte civil.

Si la persona perjudicada no tuviere la libre administración de sus bienes, se constituirá parte civil en la forma prescrita por la ley para la comparecencia en juicio de los incapaces.
