Si por motivo de las operaciones de la guerra, los funcionarios militares no pudieren ocuparse en el juzgamiento de los delincuentes, en el caso del artículo anterior, las autoridades judiciales o de policía deberán instruir el correspondiente sumario, y lo pasarán al conocimiento de los Jueces ordinarios.
