No es necesario dar noticia del rechazo al girador en cualquiera de los siguientes casos:

1° Cuando el girador' y el girado son la misma persona;

2° Cuando el girado es una persona supuesta o no tiene capacidad de contratar;

3° Cuando el girador es la persona a quien el instrumento se presenta para el pago;

4° Cuando el girador no tiene derecho para exigir o esperar que el girado o aceptante haga honor al instrumento, y

5 Cuando el girador haya contraordenado el pago.
