El Juez en quien concurra alguna de las causales expresadas, debe manifestarse impedido para conocer del asunto, exponiendo en un auto el hecho o los hechos que la constituyen.

Si el impedimento no es allanable, o si la parte a quien interese conocerlo no se ha apersonado aún en el juicio, debe disponerse en el mismo auto que se pase el expediente a quien corresponda conocer del asunto. En el caso contrario se procede como se dispone en el artículo siguiente.
