Art. 5.º Los derechos expresados en el artículo anterior los pagará la parte que los hubiere causado, ó aquella en cuyo favor se hubiere prestado el servicio, inmediatamente que se cause; ni fueren varias, se repartirán entre ellas, salvo el derecho de la que ó de las que pagaron contra la parte que en definitiva fuere condenada en costos y costas. Si una parte pagare lo que corresponde á otra ú otras, se anotará así en el expediente, para que pueda reclamársele sin demora.
