Si se hicieren reembolsos o se transfirieren utilidades en contravención a lo dispuesto en el artículo anterior, deberán venderse al Banco de la República, a la tasa del mercado intermedio, divisas extranjeras por un monto igual al del reembolso o transferencia, y además el infractor deberá pagar una multa en moneda extranjera en favor del Tesoro Nacional, hasta del cinco por ciento de dicha suma.
